CORRUPT OFFICIALS TO BE DENIED ENTRY TO THE U.S.

The U.S. Embassy announces that it will continue to apply stringently the provisions of President George W. Bush's 2004 Proclamation on denying entry to the U.S. of corrupt officials, their supporters, and their families. The U.S. Embassy will deny immigrant and non-immigrant visas to corrupt officials and other individuals that the U.S. Government identifies as falling within the definitions of this Proclamation.

Following is the text of the Presidential proclamation:

Persons Engaged in or Benefiting From Corruption

A Proclamation

In light of the importance of legitimate and transparent public institutions to world stability, peace, and development, and the serious negative effects that corruption of public institutions has on the United States efforts to promote security and to strengthen democratic institutions and free market systems, and in light of the importance to the United States and the international community of fighting corruption, as evidenced by the Third Global Forum on Fighting Corruption and Safeguarding Integrity and other intergovernmental efforts, I have determined that it is in the interests of the United States to take action to restrict the international travel and to suspend the entry into the United States, as immigrants or nonimmigrants, of certain persons who have committed, participated in, or are beneficiaries of corruption in the performance of public functions where that corruption has serious adverse effects on international activity of U.S. businesses, U.S. foreign assistance goals, the security of the United States against transnational crime and terrorism, or the stability of democratic institutions and nations.

NOW, THEREFORE, I, GEORGE W. BUSH, President of the United States of America, by the authority vested in me by the Constitution and the laws of the United States, including section 212(f) of the Immigration and Nationality Act of 1952, 8 U.S.C. 1182(f), and section 301 of title 3, United States Code, hereby find that the unrestricted immigrant and nonimmigrant entry into the United States of persons described in section 1 of this proclamation would, except as provided in sections 2 and 3 of this proclamation, be detrimental to the interests of the United States.

I therefore hereby proclaim that:

Section 1. The entry into the United States, as immigrants or nonimmigrants, of the following persons is hereby suspended:

(a) Public officials or former public officials whose solicitation or acceptance of any article of monetary value, or other benefit, in exchange for any act or omission in the performance of their public functions has or had serious adverse effects on the national interests of the United States.

(b) Persons whose provision of or offer to provide any article of monetary value or other benefit to any public official in exchange for any act or omission in the performance of such official's public functions has or had serious adverse effects on the national interests of the United States.

(c) Public officials or former public officials whose misappropriation of public funds or interference with the judicial, electoral, or other public processes has or had serious adverse effects on the national interests of the United States.

(d) The spouses, children, and dependent household members of persons described in paragraphs (a), (b), and (c) above, who are beneficiaries of any articles of monetary value or other benefits obtained by such persons.

Sec. 2. Section 1 of this proclamation shall not apply with respect to any person otherwise covered by section 1 where entry of the person into the United States would not be contrary to the interests of the United States.

Sec. 3. Persons covered by sections 1 and 2 of this proclamation shall be identified by the Secretary of State or the Secretary's designee, in his or her sole discretion, pursuant to such standards and procedures as the Secretary may establish.

Sec. 4. For purposes of this proclamation, "serious adverse effects on the national interests of the United States" means serious adverse effects on the international economic activity of U.S. businesses, U.S. foreign assistance goals, the security of the United States against transnational crime and terrorism, or the stability of democratic institutions and nations.

Sec. 5. Nothing in this proclamation shall be construed to derogate from United States Government obligations under applicable international agreements.

Sec. 6. The Secretary of State shall have responsibility for implementing this proclamation pursuant to such procedures as the Secretary may, in the Secretary's discretion, establish.

Sec. 7. This proclamation is effective immediately.

Sec. 8. This proclamation is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party, against the United States, its departments, agencies, or other entities, its officers or employees, or any other person.

KORUMPIRANIM ZVANIČNICIMA BIĆE USKRAĆEN ULAZAK U SAD

Američka ambasada objavljuje da će nastaviti striktno da primenjuje odredbe iz proglasa predsednika Džordža Buša iz 2004 o uskraćivanju ulaska u SAD korumpiranim zvaničnicima, njihovim porodicama i svima onima koji ih podržavaju. Ambasada SAD će odbiti da izda useljeničke i neuseljeničke vize korumpiranim zvaničnicima i drugim pojedincima za koje vlada SAD identifikuje da potpadaju pod definiciju ovog proglasa.

U svetlu značaja legitimnih i transparentnih javnih institucija za svetsku stabilnost, mir i razvoj i ozbiljne negativne posledice koje korupcija javnih institucija ima na napore Sjedinjenih Država da unaprede bezbednost i ojačaju demokratske institucije i sisteme slobodnog tržišta, i u svetlu značaja borbe protiv korupcije za Sjedinjene Države i međunarodnu zajednicu, kao što je to potvrdio Treći Globalni forum o borbi protiv korupcije i očuvanju integriteta, i drugi međuvladini napori, odlučio sam da je u interesu Sjedinjenih Država da preduzme mere da ograniči međunarodna putovanja i suspenduje ulazak u Sjedinjene Države, kao useljenicima i neuseljenicima, određenim osobama koje su počinile, učestvovale ili imale koristi od korupcije u obavljanju javnih funkcija, kada ta korupcija ima ozbiljne negativne efekte na međunarodne aktivnosti američkog biznisa, ciljeve američke pomoći inostranstvu, bezbednost Sjedinjenih Država u odnosu na međunarodni kriminal i terorizam i stabilnost demokratskih institucija i naroda.

SADA, DAKLE, JA, DŽORDŽ V. BUŠ, predsednik Sjedinjenih Američkih Država, na osnovu ovlašćenja koja mi pripadaju po ustavu i zakonima Sjedinjenih Država, uključujući sekciju 212 (f) Zakona o useljenju i nacionalnosti iz 1952. 8 U.S.C. 1182 (f) i sekcije 301 naslova 3, Zakona Sjedinjenih Država, odlučujem da bi neograničen useljenički i neuseljenički ulazak u Sjedinjene Države osoba opisanih u sekciji 1 ove proklamacije, izuzev kako je opisano u sekcijama 2 i 3 ovog proglasa, štetio interesima Sjedinjenih Država.

Ja ovim dakle proglašavam da:

Sekcija 1. Ovim se suspenduje ulazak u Sjedinjene Države kao useljenika i neuseljenika, sledećim osobama:

a) zvaničnicima ili bivšim zvaničnicima koji su tražili ili prihvatili bilo koji predmet novčano-materijalne vrednosti ili pribavili drugu korist u zamenu za vršenje neke usluge-dela ili zbog izostanka nekog činjenja u obavljanju svojih javnih dužnosti a koje imaju, ili su imale ozbiljne negativne posledice po nacionalne interese Sjedinjenih Država.

(b) Osobama koje su nudile da obezbede bilo koji predmet materijane vrednosti ili neku drugu korist zvaničnicima u zamenu za obavljanje ili neobavljanje javnih funkcija te osobe a koja ima, ili je imala ozbiljne negativne posledice po nacionalne interese Sjedinjenih Država.

(c) Zvaničnicima ili bivšim zvaničnicima koji su proneverili javne fondove ili se mešali u rad sudskog, izbornog, ili nekog drugog javnog procesa a koji ima ili je imao ozbiljne negativne posledice po nacionalne interese Sjedinjenih Država.

(d) Suprugama, deci i članovima domaćinstava gore navedenih lica opisanim u paragrafima (a), )b) i (c) koji su imali koristi od predmeta ili novca ovih osoba.

Sekcija 2. Sekcija 1 ovog proglasa ne odnosi se na osobe koje su inače opisane u sekciji 1 o ulazu u SAD osobama čiji ulazak nije u suprotnosti sa interesima Sjedinjenih Država.

Sekcija 3. Opunomoćenik Državnog sekretara odrediće u okviru svog diskrecionog prava a u skladu sa standardima i procedurom koju će ustanoviti Državni sekretar osobe koje podpadaju pod Sekciju 1 i 2 ovog proglasa.

Sekcija 4. Za potrebe ovog proglasa, "ozbiljne negativne posledice" po nacionalne interese Sjedinjenih Država ima značenje ozbiljnih negativnih efekata na polju međunarodnih ekonomskih aktivnosti američkog biznisa, američke pomoći inostranstvu, bezbednosti SAD u borbi protiv međunarodnog kriminala i terorizma, ili stabilnosti demokratskih institucija i nacija.

Sekcija 5. Ništa iz ovog proglasa ne treba shvatiti kao ograničavanje obaveza vlade SAD prema važećim međunarodnim sporazumima.

Sekcija 6. Državni sekretar je obavezan da primenjuje ovaj proglas shodno proceduri koju on kao Državni sekretar, a na osnovu diskrecionog prava, može da uvede.

Sekcija 7. Ovaj proglas stupa na snagu odmah.

Sekcija 8. Ovaj proglas nije namenjen da, niti stvara bilo kakva prava ili koristi suštinske, ili proceduralne, zakonski primenljive ili pravične od bilo koje stranke, protiv SAD, njenih ministarstava, agencija, ili drugih tela, njenih službenika ili zaposlenih, ili bilo koje treće osobe.

Zbog čega kao svedočanstvo, ovde stavljam svoj potpis današnjeg dvanaestog dana januara, u godini Gospodnjoj dve hiljade četvrtoj, i u dvesta dvadeset osmoj godini nezavisnosti Sjedinjenih Država.
